OFFICIAL CONTEST RULES

7-ELEVEN FREEZE THE MOMENT VIDEO CONTEST (“CONTEST”)

THIS CONTEST IS OPEN TO CANADIAN RESIDENTS ONLY AND IS GOVERNED BY CANADIAN LAW.

ELIGIBILITY:

Contest is open to all legal residents of Canada (excluding residents of Quebec) who are thirteen (13) years of age or older at the time of entry, except employees or agents (and those with whom they are domiciled) of the Sponsor (as defined below), its advertising and promotion agencies and the contest judges.

 

Minors: If you are under the age of majority in your province/territory of residence, then you will be required to submit (in addition to the information noted below) your parent/legal guardian’s email address in order to enter the Contest.  The Sponsor will contact your parent/legal guardian for the purpose of verifying his/her agreement on your behalf to the terms and conditions outlined in these Official Contest Rules (the “Rules”).

 

HOW TO ENTER:

No purchase necessary. Contest begins on June 17, 2010 at 12:00:01 Pacific Time Eastern Time (PT) and the entry deadline is August 15, 2010 at 11:59 pm PT (the “Contest Period”). 

 

To enter, visit slurpee.ca and go to “Freeze the Moment” (the “Contest Website”) and follow the links provided to register for the promotion by inputting your email address, first name, last name, and mobile phone number and a password. You will be asked to acknowledge that you have read these Rules and that you are 13 years of age or over. Throughout the Contest Period, you may also enter the Contest in person at participating 7-Eleven stores, during live radio station remotes which will occur from time to time in the following major markets: Vancouver, Calgary, Edmonton and Winnipeg. Upon completing the contest entry form, you will then receive an email requiring you to verify your account by following the steps outlined. Once your account is set up and verified, create an original video that demonstrates your “Slurpee Frozen Moment” and is otherwise in compliance with the specific requirements contained in these Rules. Then, sign into your account and upload your video, proving a title and description.  Your uploaded video and submitted registration form are collectively referred to in these Rules as your “Entry”.  Video need not contain actual Slurpee product or package.

 

Limit of one (1) entry per person/email address for each original video permitted during the Contest Period. An individual may enter more than one original video. If it is discovered that you attempted to enter the same original video more than once during the Contest Period, then all your Entries will be void.  Entries will be rejected if: (a) registration form is not fully completed (including video upload) and submitted during the Contest Period; or (b) if the video does not conform to the specific requirements listed below.  Without limitation, 7-Eleven Canada, Inc. (the “Sponsor”), its advertising and promotion agencies and the contest judges are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries.

BY SUBMITTING A VIDEO, THE ENTRANT (AND HIS/HER PARENT/LEGAL GUARDIAN IF HE/SHE IS UNDER THE AGE OF MAJORITY IN HIS/HER JURISDICTION OF RESIDENCE) AGREES THAT THE VIDEO COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE SPONSOR AND THOSE ASSOCIATED WITH IT WILL BEAR NO LEGAL LIABILITY, EXPRESSED OR IMPLIED, REGARDING THE USE OF THE VIDEO BY THE SPONSOR AND THE SPONSOR SHALL BE HELD HARMLESS BY AN ENTRANT IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT THE ENTRANT HAS DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE RULES. 

VIDEO REQUIREMENTS:

Your submitted video must never have been previously exhibited publicly or selected as a winner in any other contest. To be eligible for entry in the Contest, your video must meet the following specific requirements:

Invite your friends and family to view your video. This year our judging panel will consider the number of views in choosing the 2010 winner. So don't forget to promote your entry on your MySpace page, Facebook, Twitter or other social networking sites.

By participating in the Contest, each entrant (and his/her parent/legal guardian if he/she is under the age of majority in his/her jurisdiction of residence) agrees to be bound by Rules and by the interpretation of these Rules by the Sponsor, and further warrants and represents that his/her video:

 

i. is original to him/her and that the entrant has all necessary rights in and to the video and all of its components (if applicable) to enter the video in the Contest.  For example, you must have permission to use any and all pictures, photographs, and/or music contained in your video;
ii. does not and will not violate any law, statute, ordinance or regulation;
iii. does not contain any reference to or likeness of any third parties, unless consent has been obtained from all such individuals (NOTE: if a video contains any third parties who are under the age of majority in their province or territory of residence, then consent must also be obtained from any such persons’ parent or legal guardian);
iv. will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and
v. is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:
  • Nudity;
  • Explicit, graphic or excessive sexual activity;
  • Crude, vulgar or offensive language and/or symbols;
  • Derogatory characterizations of any ethnic, racial, sexual or religious groups;
  • Content that endorses, condones or discusses any illegal, inappropriate or risky activity, behaviour or conduct;
  • Personal information of individuals, including without limitation, names and addresses (physical or e-mail);
  • Conduct or other activities in violation of these Rules;
  • Commercial messages, comparisons or solicitations for products or services;
  • Any identifiable third party products and/or trade-marks, brands or logos.  For example, any clothing worn by persons appearing in a Video/Photo must not contain any visible logos, trade-marks or other third party materials;
  • URLs or links to any websites; and
  • Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor and/or the contest judges in their sole discretion.

 

The Sponsor and/or the contest judges will initially screen every video within twenty four (24) hours of that video being submitted. Any video that the Sponsor and/or the contest judges deem, in their sole discretion, to violate the terms and conditions set forth in these Rules will not be posted.  Any video that is deemed appropriate and compliant will be posted on the Contest Website and the entrant will receive an email notification from Sponsor indicating that the video has been posted. 

 

By entering the Contest and uploading a video, each entrant (and his/her parent/legal guardian if he/she is under the age of majority in his/her jurisdiction of residence): (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use the video in whole or in part on the Website and/or for advertising or promoting the Contest or for any other reason; and (ii) agrees to release and hold harmless the Sponsor and its advertising and promotion agencies, the contest judges and each of their respective agents, employees, directors, successors, and assigns against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action.  For greater certainty, the Sponsor and/or the Contest judges reserve the right, in their sole discretion, to modify, edit or remove any video, or to request an entrant to modify or edit his or her video, if a complaint is received with respect to the video, or for any other reason.  

PRIZES:  

DAILY PRIZES: There will be forty-two (42) Daily Prizes awarded (one for each day, in accordance with the timeframes described below, during the Contest Period), each consisting of one (1) “Freeze the Moment” Slurpee branded t-shirt and five (5) free Slurpee vouchers. Total approximate retail value of daily prizes is $25.00.

WEEKLY PRIZES: There will be seven (7) Weekly Prizes awarded (one for each week during the Contest Period, in accordance with the timeframes described below), each consisting of one (1) SpeakOut Nokia 2729 Wireless Phone, plus 100 free airtime minutes, one (1)  Apple 32 GB Ipod Touch and five (5) Free Slurpees. Total approximate retail value of weekly prizes is $500.00). iPod Touch is a registered trademark of Apple Inc. Apple is not a sponsor of, nor a participant in this promotion. NOKIA is a registered trademark of Nokia Corporation. Nokia is not a sponsor of, nor a participant in this promotion.

GRAND PRIZE: There will be one (1) Grand Prize awarded, consisting of five thousand dollars CDN. ($5000) plus three hundred sixty-five Slurpee products. Total approximate retail value of Grand Prize is $5730.00. The winner of the Grand Prize may also receive the right, in the Sponsor’s discretion, to have his/her winning video featured in a 7-Eleven television commercial, such right being subject to the winner signing assignment and transfer and other legal documents in favour of 7-Eleven. 

All prizes must be accepted as awarded. No substitutions except at Sponsor’s option. Sponsor reserves the right to substitute a prize or a prize component with one of equal or greater value.  Maximum of one (1) Grand Prize and one (1) Weekly Prize per person/email address permitted during the Contest Period.  All Weekly and Daily Prize winners remain eligible to win the Grand Prize. Prizes will only be awarded to the person whose name and e-mail address appears on the Entry.  Sponsor, its advertising and promotion agencies and the Contest judges are not responsible for the distribution of a prize between any persons who may have participated collaboratively in making the video.

WEEKLY PRIZE WINNER SELECTION PROCESS:

On Friday of each week during the Contest Period (starting on July 2, 2010), a random draw will be conducted from all Entries received by 11:59 pm the previous day, to select one (1) entry to be eligible to win the weekly prize. Odds of winning a weekly prize in a particular weekly draw will depend upon the number of eligible entries received prior to the entry deadline for that particular draw. All Entries except those already selected to win a weekly or daily prize will be eligible for all weekly draws for which the deadline has not already passed when they are received.

DAILY PRIZE WINNER SELECTION PROCESS:

Each day during the Contest Period commencing July 3, 2010, at approximately 5:00 pm PST, a random draw will be conducted from all Entries received by 4:00 pm PT that day, to select one (1) entry to be eligible to win the daily prize. Odds of winning a daily prize in a particular daily draw will depend upon the number of eligible Entries received prior to the entry deadline for that particular draw. All Entries (except those already selected to win a weekly or daily prize) will be eligible for all daily draws for which the deadline has not already passed when they are received.

WEEKLY AND DAILY PRIZE FULFILLMENT:

Selected entrants for daily and/or weekly prizes will be contacted by phone or email within five (5) business days of selection.  If you have not been contacted within such period, you may assume that you are not a selected entrant for that particular day or week.  Before being declared a DAILY PRIZE WINNER, each selected entrant must correctly answer a time-limited mathematical skill-testing question to be administered by telephone or email in the Sponsor’s discretion. BEFORE BEING DECLARED A WEEKLY PRIZE WINNER, each selected entrant must correctly answer a time-limited mathematical skill-testing question to be administered by telephone or email or otherwise in the Sponsor’s discretion and sign (and have his/her parent/legal guardian sign if he/she is under the age of majority in his/her jurisdiction of residence) and return within ten (10) business days of notification a declaration and release prepared by the Sponsor, which, among other things: (i) requires the selected entrant to confirm compliance with the Rules and acceptance of prize as offered; (ii) releases Sponsor, its agents, and the prize suppliers with respect to injuries, accident, loss or damages relating to the Contest or the awarding of the prize and indemnifies the Sponsor, its advertising and promotion agencies and the Contest judges against any and all claims, damages, liabilities, costs, and expenses incurred in connection with (a) the Contest and the selected entrant’s  participation therein; (b) the selected entrant’s acceptance, use or misuse of a prize or any portion thereof; and/or (c) use of the selected entrant’s video, including without limitation, any claim that the video infringes a proprietary interest of any third party; (iii) acknowledges the Sponsor’s and its agents’, subsidiaries’ or affiliates’ right to publish and/or broadcast the winner's picture, name, address, voice, statements without further compensation other than the prize offered; and (iv) requires the selected entrant to correctly answer a time-limited mathematical skill-testing question if one has not already been correctly answered. If a selected entrant: (a) cannot be contacted by phone or email by within five (5) business days of selection; (b) fails to correctly answer the skill-testing question; or (c) fails to return the contest documents within the specified time, then he/she will forfeit the prize and their opportunity to be a winner and another eligible entrant will be selected.  

GRAND PRIZE WINNER SELECTION PROCESS:

A panel of judges appointed by the Sponsor will judge all posted videos on the basis of originality, creativity, uniqueness, and best representation of the Slurpee brand.  The video with the highest total score (“Score”) will be deemed to be the Grand Prize selected entrant.  Odds of your video being selected by the judging panel depend on the calibre of the judged videos and on the decisions of the judging panel. All criteria will be weighed equally.  In the event of a tie based on total Score, the video with the highest score on creativity will be deemed to be the Grand Prize selected entrant.  In applying the criteria referenced above, the judging panel will also take into account and consider, but not be bound by, the popularity of each Entry as measured by the total number of associated video views.

GRAND PRIZE FULFILMENT:

Judging will be completed and the Grand Prize selected entrant will be contacted by email or phone by August 27, 2010. If you have not been contacted by this date, you may assume that you are not the Grand Prize selected entrant.  Before being declared THE GRAND PRIZE WINNER, the selected entrant must sign (and have his/her parent/legal guardian sign if he/she is under the age of majority in his/her jurisdiction of residence) and return within ten (10) business days of notification a declaration and release prepared by the Sponsor which, among other things: (i) requires the selected entrant to confirm compliance with the Rules and acceptance of prize as offered; (ii) confirms originality and ownership of and assigns all intellectual property, including copyright, in and to his/her video and waives his/her moral rights therein in favour of the Sponsor; (iii) releases Sponsor,  its agents, and the prize suppliers with respect to injuries, accident, loss or damages relating to the Contest or the awarding of the prize and indemnifies the Sponsor, its advertising and promotion agencies and the Contest judges against any and all claims, damages, liabilities, costs, and expenses incurred in connection with (a) the Contest and the selected entrant’s  participation therein; (b) the selected entrant’s acceptance, use or misuse of a prize or any portion thereof; and/or (c) use of the selected entrant’s video, including without limitation, any claim that the video infringes a proprietary interest of any third party; (iv) acknowledges the Sponsor’s and its agents’, subsidiaries’ or affiliates’ right to publish and/or broadcast the winner's picture, name, address, voice statements, and video, including the use of their video and their personal performance therein in television commercial(s), without further compensation other than the prize offered; (v) requires the selected entrant to correctly answer a time-limited mathematical skill-testing question; and (vi) contains the selected entrant’s acknowledgment that they and/or their video may be featured in a television commercial, along with their agreement to agree to sign such further documents as may be necessary, as determined by 7-Eleven in its discretion,  relating to their performance in any such commercial.  If the selected entrant: (a) cannot be contacted by phone or email by August 31, 2010; or (b) fails to return the contest documents within the specified time, then he/she will forfeit the prize and their opportunity to be a winner and the next eligible entrant will be selected (based on the next highest Score). Any persons other than the Grand Prize selected entrant who appear to any degree and in any manner in the Grand Prize selected entrant’s video (or their parent or legal guardian if any such selected entrant is under the age of majority in  his/her province of residence) will also be required, as a condition of the Grand Prize selected entrant being declared a winner, to sign release and waiver documentation acknowledging Sponsor’s and its agents’ right to publish and/or broadcast their name, address, voice statements, and video, including the use of their video and their personal performance therein in television commercial(s), acknowledging that the Grand Prize selected entrant’s video may be featured in a television commercial, and agreeing to sign such further documents as may be necessary, as determined by 7-Eleven in its discretion,  relating to their performance in such video and in any such commercial.

GENERAL CONDITIONS:

By entering the Contest, each entrant (and his/her parent/legal guardian if he/she is under the age of majority in his/her jurisdiction of residence) agrees to the use of their name, address, voice, statements about the contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet.

Without limitation, the Sponsor, its advertising and promotion agencies and the contest judges will not be liable for any failure of the Contest Website during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Sponsor, its advertising and promotion agencies or the contest judges for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above.  Further, the Sponsor, its advertising and promotion agencies and the contest judges will not be liable for any injury or damage to an entrant’s or any other person’s computer or data contained therein, related to or resulting from participating or downloading any material in the Contest.

The Sponsor reserves the right to withdraw or amend this Contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Rules.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.

This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the contest judges with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries.

In the event of a dispute, online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry.  “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.  If the identity of an online entrant is disputed, the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant.  A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry.  The sole determinant of the time for the purposes of a valid online entry in this contest will be the contest server machine(s).

The Sponsor reserves the right to cancel or suspend this Contest, or to amend these Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind.

By entering this Contest, each entrant (and his/her parent/legal guardian if he/she is under the age of majority in his/her jurisdiction of residence) expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the contest and in accordance with Sponsor’s Privacy Policy (available at www.slurpee.ca), unless the entrant (and/or his/her parent/legal guardian if he/she is under the age of majority in his/her jurisdiction of residence) otherwise agrees.
