OFFICIAL CONTEST RULES
NAME YOUR FLAVOUR SLURPEE CONTEST (“CONTEST”)
THIS CONTEST IS OPEN TO CANADIAN RESIDENTS ONLY
AND IS GOVERNED BY CANADIAN LAW.
Contest is open to all legal residents of British Columbia, Alberta, Saskatchewan, Manitoba and Ontario who have reached the age of 13 years or older in their province/territory of residence at the time of entry, except employees or agents (and those with whom they are domiciled) of the 7-Eleven Canada, Inc. (the “Sponsor”), its advertising and promotion agencies and the contest judges.
HOW TO ENTER:
No purchase necessary. Contest begins on May 3, 2016 at 12:00:01 Pacific Time (“PT”) and the Entry Period deadline is June 19, 2016 at 11:59 pm PT (the “Contest Period”). After the end of the Entry Period, a panel of judges will select five (5) entries from among all eligible entries. 7-Eleven will post the top five (5) entries on Slurpee.ca for public voting. The Voting Period is June 23, 2016 12:01 am to July 1, 2016, 11:59 PT. (see Grand Prize Winner Selection Process below).
To enter, visit www.slurpee.ca (the “Contest Page”) and submit your entry for the Contest by inputting your first name, last name, email address, and contact phone number, then submit your name for the Name Your Flavour Slurpee in your submission form.
You will be asked to acknowledge that you have read and agree to comply with these official rules (“Rules”). You will be entered in the Contest once you complete and submit the registration form and submit your name. Your Name Your Slurpee submission form is collectively referred to in these Rules as your “Entry”. If an entrant has already submitted the same name, you will be notified within twenty-four (24) hours so you can submit a new entry.
LIMIT of 10 (10) entries per person/email address throughout the Contest Period. If it is discovered that you attempted to enter the Contest more than ten times during the Contest Period, then all your entries will be void. Entries will be rejected if: (a) registration form is not fully completed (including name) and submitted during the Contest Period; or (b) if the name does not conform to the specific requirements listed below. Without limitation, the Sponsor, its advertising and promotion agencies and the Contest judges are not responsible for late, lost, misdirected, delayed, incomplete or incompatible entries.
Voting: In order to submit votes in the Contest, you must check the box of the preferred name on the page after June 23, 2016 12:01 am PT and before July 1, 2016 11:59 pm PT as set out above. If you do not submit a name, you will not be eligible to win any prizes.
BY SUBMITTING A NAME, THE ENTRANT AGREES THAT THE NAME COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE SPONSOR AND THOSE ASSOCIATED WITH IT WILL BEAR NO LEGAL LIABILITY, EXPRESSED OR IMPLIED, REGARDING THE USE OF THE NAME BY THE SPONSOR AND THE SPONSOR SHALL BE HELD HARMLESS BY AN ENTRANT IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT THE ENTRANT HAS DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE RULES. ANY NAME FINALIZED OR SELECTED WILL BE SUBJECT TO COPYRIGHT.
Your submitted name is evaluated upon the quality, brand connection, and creativity. Names must not already be subject to copyright and must be submitted with your name and entry. Your submitted name must never have been previously exhibited publicly or selected as a winner in any other contest. To be eligible for entry in the Contest, your name must meet the following specific requirements:
- By participating in the Contest, each entrant agrees to be bound by Rules and by the interpretation of these Rules by the Sponsor, and further warrants and represents that his/her name:
- is original to him/her and that the entrant has all necessary rights in and to the name and all of its components (if applicable) to enter in the Contest;
- does not and will not violate any law, statute, ordinance or regulation;
- will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and
- is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:
- Sexual; crude, vulgar or offensive language and/or symbols;
- Derogatory characterizations of any ethnic, racial, sexual or religious groups;
- Content that endorses, condones or discusses any illegal, inappropriate or risky activity, behaviour or conduct;
- Personal information of individuals, including without limitation, names and addresses (physical or e-mail);
- Conduct or other activities in violation of these Rules;
- Commercial messages, comparisons or solicitations for products or services;
- Any identifiable third party products and/or trade-marks, brands or logos.
- URLs or links to any websites; and
- Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor and/or the contest judges in their sole discretion.
The Sponsor and/or the Contest judges will initially screen every name within twenty four (24) hours of that name being submitted. Any name that the Sponsor and/or the Contest judges deem, in their sole discretion, to violate the terms and conditions set forth in these Rules will not be posted. Any name that is deemed appropriate and compliant will be posted on the Contest Website and the entrant will receive an email notification from Sponsor indicating that the name has been posted.
By entering the Contest and submitting a name, each entrant: (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use the name in whole or in part on the Contest Website and/or for advertising or promoting the Contest or for any other reason; and (ii) agrees to release and hold harmless the Sponsor and its advertising and promotion agencies, the contest judges and each of their respective agents, employees, directors, successors, and assigns against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action. For greater certainty, the Sponsor and/or the Contest judges reserve the right, in their sole discretion, to modify, edit or remove any name, or to request an entrant to modify or edit his name, if a complaint is received with respect to the name, or for any other reason.
GRAND PRIZE: There is one (1) Grand Prize available to be won, consisting of five thousand / $5,000.00 dollars (CAD), plus $5,000.00 dollar (CAD) donation to a registered non-denominational Canadian charity, as approved by the 7-Eleven Panel of Contest Judges (total approximate retail value $10,000.00).
All prizes must be accepted as awarded. No substitutions except at Sponsor’s option. No cash option for the charitable donation. Sponsor reserves the right to substitute a prize or a prize component with one of equal or greater value. Prizes will only be awarded to the person whose name and e-mail address appears on the Entry. GRAND PRIZE WINNER SELECTION PROCESS:
After the end of the Entry Period on June 19, 2016 at 11:59 PT, a panel of judges appointed by the Sponsor will judge all the entries submitted. Odds of winning are based upon the quality, brand connection, and creativity of your name submission and the votes received during the voting period. 7-Eleven will post the five (5) selected judges entries on Slurpee.ca for public voting. The name with the highest number of votes at the end of the Voting Period on July 1, 2016, 11:59 pm will be selected as the Grand Prize entrant. Votes received and decisions of the judging panel are final and made in the panel’s sole and exclusive discretion. In the event of a tie, Sponsor reserves the right to select the final winner.
Public voting on names submitted in the Contest will be available between June 23, 2016 at 12:00:01 PT and July 1, 2016 at 11:59 pm PT (the “Voting Period”). See “Voting Terms and Conditions” below for important voting rules.
GRAND PRIZE FULFILMENT:
Judging will be completed and the Grand Prize selected entrant will be contacted by email or phone by approximately July 4, 2016. If you have not been contacted by this date, you may assume that you are not the Grand Prize selected entrant. Before being declared THE GRAND PRIZE WINNER, the selected entrant must sign and return within ten (10) business days of notification a declaration and release prepared by the Sponsor which, among other things: (i) requires the selected entrant to confirm compliance with the Rules and acceptance of prize as offered; (ii) confirms originality and ownership of and assigns all intellectual property, including copyright, in and to his/her name and waives his/her moral rights therein in favour of the Sponsor; (iii) releases Sponsor, its agents, and the prize suppliers with respect to injuries, accident, loss or damages relating to the Contest or the awarding of the prize and indemnifies the Sponsor, its advertising and promotion agencies and the Contest judges against any and all claims, damages, liabilities, costs, and expenses incurred in connection with (a) the Contest and the selected entrant’s participation therein; (b) the selected entrant’s acceptance, use or misuse of a prize or any portion thereof; and/or (c) use of the selected entrant’s name, including without limitation, any claim that the name infringes a proprietary interest of any third party; (iv) acknowledges the Sponsor’s and its agents’, subsidiaries’ or affiliates’ right to publish and/or broadcast the winner’s picture, name, address, voice statements, and name, without further compensation other than the prize offered; (v) requires the selected entrant to correctly answer a time-limited mathematical skill-testing question; and (vi) contains the selected entrant’s acknowledgment that they agree to sign such further documents as may be necessary, as determined by 7-Eleven in its discretion. If the selected entrant: (a) cannot be contacted by phone or email by July 15, 2016; or (b) fails to return the contest documents within the specified time, then he/she will forfeit the prize and their opportunity to be a winner and the next eligible entrant will be selected by the judging panel.
VOTING TERMS AND CONDITIONS:
To participate as a Voter in this Contest you must simply check the preferred name of your choice during the voting period between June 23, 2016, 12:01 am PT and on or before July 1, 2016 1159 pm PT. There is a limit of one (1) vote per person/email address permitted per day (each day being a 24 hour period from 12:01 am to 11:59 pm) during the Voting Period and a Voter can only use one (1) email address register to vote. If it is discovered that a voter has attempted to: i) cast more votes than they were eligible to cast during the Contest Period; (ii) use (or attempt to use) multiple names, identities, email addresses and/or any automated, script, macro or robotic program(s) to submit votes; and/or (iii) engage in systematic voting from the same computer/IP address; then (in the sole and absolute discretion of the Sponsor) he/she may be disqualified from participating in the Contest and all of his/her votes may be disqualified. Any votes determined by Sponsor to be in violation of these Rules (including, without limitation, votes determined to be coming from any source other than a Registered Participant) are subject to disqualification in the sole and absolute discretion of the Sponsor. All votes and Accounts are subject to verification. Use (or attempted use) of multiple identities, email addresses and/or any automated system, robotics, to register for, vote, or otherwise participate in this Contest is prohibited and is grounds for disqualification. Any votes determined by Sponsor to be in violation of these Rules (including, without limitation, votes determined to be coming from any source other than a registered voter) are subject to disqualification in the sole and absolute discretion of the Sponsor. The Sponsor is not responsible for late, lost, misdirected, delayed, incomplete or incompatible votes.
All votes are subject to verification. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor) from any entrant (or any individual purporting to be an entrant) to participate in this Contest or for any votes entered, or purportedly entered, by such voter to be considered valid for the purposes of this Contest. Failure to provide such proof in a timely manner may result in disqualification of the applicable votes that cannot be verified to the satisfaction of the Sponsor, in its sole and absolute discretion. The sole determinant of the time for the purposes of a valid voter registration and/or vote in this Contest will be the Contest server machine(s).
IMPORTANT NOTE: Individuals may encourage other individuals to vote for an Entry (e.g. via various social media sites and platforms); however, no form of incentive, inducement, prize or chance of receiving any incentive, inducement, or prize may be offered as part of such encouragement in furtherance of receiving such individual’s vote for any entry. Any individual determined by the Sponsor and/or its representative to be engaging in such behaviour will be disqualified, and the corresponding votes, entry and/or entrant is subject to disqualification in the sole and absolute discretion of the Sponsor.
By entering the Contest, each entrant agrees to the use of their name, address, voice, image, photo, statements about the contest and/or name or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet.
Without limitation, the Sponsor, its advertising and promotion agencies and the contest judges will not be liable for any failure of the Contest Website during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Sponsor, its advertising and promotion agencies or the contest judges for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above. Further, the Sponsor, its advertising and promotion agencies and the contest judges will not be liable for any injury or damage to an entrant’s or any other person’s computer or data contained therein, related to or resulting from participating or downloading any material in the Contest.
The Sponsor reserves the right to withdraw or amend this Contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the contest judges with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries.
In the event of a dispute, online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If the identity of an online entrant is disputed, the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry. The sole determinant of the time for the purposes of a valid online entry in this contest will be the contest server machine(s).
The Sponsor reserves the right to cancel or suspend this Contest, or to amend these Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind.
